Attempted murder case dismissed by Yuma judge

YUMA, Ariz. – An attempted murder case has been dismissed by a Yuma County judge.

Barry Douglas Todd was arrested two years ago after he shot a man at LZ Bar and Grill.

The case was dismissed last week after the prosecution failed to present evidence showing probable cause of Todd breaking the law, according to Todd’s attorney Mike Kimerer.

Kimerer says the case was presented to three separate grand juries including one where the prosecution never gave instructions of possible self-defense on Todd’s behalf during the shooting.

Eventually the case was dismissed in a preliminary hearing where the judge decided there was not enough evidence to prosecute Todd of the charges against him.

The prosecution was not available for comment.
